Those who are arguing that Andrew or others could or could not defend
themselves should they be sued are missing an important point: a lawsuit
costs a minimum of $30,000 to $50,000 to defend, even if it is dismissed.
Most individuals and small companies cannot afford to be sued in the first
place. Many larger companies face much higher legal costs to defend large
discrimination or class-action suits that the existence of a test can
trigger. No wonder many companies avoid tests.
