SPA (don't remember what the TLA stands for, but it's an organization that cracks down on software piracy) has been running ads here lately offering a "grace period" to get your software licensed before they start breaking legs. ;-) Their ad points out that most of the reports of illegal software they receive are submitted by current and former employees. And they point out that if you *have* current and former employees, you are at risk of being reported. Since they're threatening the employers, and not the employees, I would agree with your theory that the employer is the one who would be busted.

Of course, this situation presents an ethical dilemma; do the work and
break the law in the process by using illegal software, or take a stand
and put myself out of a job. In this case I can't afford to take a stand.
Of course, my impression is that if anyone got busted for the illegal
software it would be the employer, not me.

I'd have to guess that my situation is hardly unique.
