This is true. I have sent off-list emails to list members either offering or requesting advice, opinions, etc., on matters that were too far removed from technical writing to be discussed on-list, and apparently, everyone involved thought those messages were legitimate. But I think, if I'm reading between the original post's lines correctly, that it was referring specifically to off-list communication that the list owner wouldn't approve of. For example, Eric's rules specifically forbid anyone from collecting list email addresses for the purpose of a mass mailing to sell something. So that could be considered spam, especially if you used a different email address to try and hide what you were doing.

You're partially wrong: off-list e-mails are important. If it's not topical for the list, the standard practice is to communicate privately. It helps keep lists on-topic while allowing members the opportunity to explore related topics that are not of interest to the group at large.
