You have to use TM when the trademark has been applied
for, but has not yet been accepted by the U.S. Patent Office
as a trademark.

The symbol R in a circle ("r" for registered) means that the
trademark has been accepted by the patent office.
Note, NEVER use (R); it isn't mentioned in law and therefore
has no legal status.
