Yes, a group called the National Writers Association pushed this through, apparently under the impression that all software industry writers were just underpaid, overworked DTP operators doing nothing but formatting what developers throw over the walls at them. I don't know, maybe those software writers who belong to the NWA actually are. So if you work in California on products that are primarily software, under the NWA's stupid pet law you can only be hired hourly, unless you can somehow manage to carry your own 1099 contract. Fortunately for people like me, the NWA was apparently also under the impression that there are no other technical writers BUT software industry writers, because that section of code is very narrowly targeted and fairly easy to avoid as long as you are not working on products that are primarily software.

I assume that this only applies to hourly work? I assume one can be a salaried employee and write software documentation? Or by definition, based on California Labor Code Â515.5(b)(5), if you do the kind of work described there do you have to be hourly/non-exempt?

Pardon my ignorance. I've been working in other areas of high tech the last several years (until being laid off last July) and it's been a number of years since I've been directly involved with tech pubs.

Thanks,

Mike

Screwed how?

I have a great job in the software business and it was my choice whether to go staff or 1099. Which previous jobs I've liked and disliked correlates not at all with my staff / contractor status.

Yes, you're right. If you're working as a "computer industry"
technical writer, you're screwed. I keep forgetting this because I'd
rather work as a greeter at Wal Mart than take a W2 job in that field.
