I think this calls into play the whole "at will" employment status that seems so widespread here in the US. While it seems unfair that an employer can literally and legally terminate you because they suddenly don't like the color of your eyes, by the same token, employees can also walk away from almost any employment situation with no legal ramifications on their part.

My guess is that any uphill battle is mostly in the employer's favor, as they tend to have legal resources available should they need them. Where the candidate may be financially struggling just to get by. Even if they did have the resources and ability to fight it, would they really WANT the negative job climate that would almost inevitably ensue if they won?
