A real 1099 contractor is not the same as a W2 temp
"contractor" as far as the IRS and most states' labor
laws are concerned and should not be considered
"headcount," except perhaps where cost calculation
is involved. One issue might be whether you have
been maintaining compliance on the corp-to-corp
writer by treating him/her like a vendor and not a
regular employee. If the corp-to-corp has a regular
desk in the office, is working with company-supplied
tools and software, is keeping regular in-office hours,
etc., you could have a problem.
