A couple of notes came up on the News site related to this topic:

As usual in issues like this the porn folks are on the frontier. This
involves a judge issuing a restraining order against using Playboy's name
in a metatag without its permission.

This concerns the use of a name of one of the partners in a law firm by a
different site to draw vistors to other sites.

Neither case has been concluded as yet, so there's no solid precedence. The
first story is a preliminary injunction, but it's possible that it will
serve as a precedent nonetheless.
